Federal disaster payments for areas that have suffered severe crop losses have been around for a long time. However, they have usually been implemented on an ad hoc basis each time widespread production problems arose. The new farm bill changed this. The 2008 farm bill created an Agricultural Disaster Trust Fund. A major part of this fund will fi nance Supplemental Revenue Assistance (SURE) payments, which are designed to supplement the protection producers can purchase from private crop insurance companies.

Farmers who signed up for the Average Crop Revenue Election (ACRE) can change their crop priority by September 30. Crop priority determines which crop receives priority for ACRE payments. If corn is picked as the first priority and soybeans the second priority, ACRE payments will be received on the maximum number of planted corn acres and the remainder of eligible acres will be allocated to soybeans. Conversely, ACRE payments will be received on the maximum number of soybean acres if soybeans are chosen as the first priority. The default is “no priority”, in which case ACRE payments are received in proportion to planted acres.

The 2008 farm bill offers farmers the option to continue receiving DP, CCP, and LDP/MLG payments (DCP), or receive average crop revenue election (ACRE) payments, with a 20% reduction in DP and a 30% reduction in loan rates for LDP/MLG. The decision to elect ACRE is irrevocable over the life of the farm bill. Signup is for each farm unit, so farmers do not have to elect ACRE or DCP for all farm units.

This program is a revenue counter-cyclical program that is designed to provide support to producers when crop revenue falls below the established revenue guarantee. Established as a program to replace the price counter-cyclical program, which only provides support when prices fall, ACRE is a new concept for commodity programs that offers the opportunity to provide support when yields are reduced as well.

The Supplemental Revenue Assistance Program (SURE) is funded by the Agriculture Disaster Relief Trust Fund to provide crop disaster assistance payments to eligible producers on farms in disaster counties that have incurred crop production losses (excluding grazing), crop quality losses, or both during the crop year. Crop disaster payments to eligible producers will be made at 60 percent of the difference between the disaster assistance program guarantee and the total farm revenue for the farm. The disaster assistance program guarantee for a crop used to calculate the payments for a farm may not be greater than 90 percent of the sum of the expected revenue for each of the crops for the farm.

The Food, Conservation, and Energy Act of 2008 (the 2008 Farm Bill) allows producers a one-time opportunity to select an alternative safety net for their farm. Rather than the DCP (Direct and Countercyclical Payment) Program, producers may elect ACRE (Average Crop Revenue Election).

A fundamental change in commodity title programs in the 2008 Farm Bill resulted in the creation of the new Average Crop Revenue Election Program (ACRE). ACRE is a revenue-based support program that effectively acts as a put option on state-level revenue for each program crop. Starting with the 2009 crop year, producers of program crops will have the option of electing coverage under ACRE, or defaulting to support under the existing suite of commodity programs. This choice will be made on a FSA farm basis. The decision can be deferred to future crop years, but if a farm is elected into the ACRE program, the decision is irrevocable. Thus, once elected, the farm will be covered by ACRE throughout the life of the current Farm Bill which goes through the 2012 crop year.
